SUBJECT: Riparian Buffer revisions to Chapter 23, Chesapeake Bay Preservation Ordinance
The Board of Supervisors approved changes to the Powhatan Creek and Yarmouth Creek Watershed Management Plans on October 10, 2006, with the understanding that staff would bring forth an ordinance to codify the changes. The changes to the watershed management plans were presented to the Planning Commission at the regularly scheduled September 11, 2006 meeting.
At the December 11, 2007, BOS meeting, staff presented the requested ordinance amendment and a grandfathering resolution that were passed by a vote of 4-1. At the January 8, 2008, meeting, the BOS approved to rescind the same ordinance by a 3-2 vote. At that meeting, staff was directed to work on the ordinance language, specifically notify the affected mainstem property owners, present the revised language to the Policy Committee in January 2008, and present the revised language to the full Planning Commission on February 6, 2008, for comment.
After the Policy Committee meeting and the Planning Commission meeting, a work session will be held on February 26, 2008, with the BOS before staff brings the matter before them again for a public hearing. Please find attached the proposed ordinance language and grandfathering resolution. Staff will also be doing a presentation for the Policy Committee.
